Washington State's New Law Mandates Employers to Disclose Salary Ranges and Compensation Details in Job Postings
As of March 30, 2022, Washington's Governor, Jay Inslee, signed into law Senate Bill (SB) 5761, which requires all employers with fifteen or more employees to disclose the salary ranges, wage scales, benefits, and other compensation details in all job postings open to applicants.
Effective January 1, 2023, this law expands the state's Equal Pay and Opportunities Act (EPOA) and offers additional protections for job seekers and employees, including applicants for employment, transfers, or promotions. Unlike the previous amendment that required disclosure upon request, the new law mandates affirmative disclosure in job postings. However, employers must still provide this information to employees offered new positions or promotions when requested. It's worth noting that the law broadly defines a job posting as any solicitation to recruit applicants, whether done directly or through a third party, electronically or in print. Additionally, the law applies to public and private employers operating in Washington, irrespective of where their employees are. Employers who fail to comply with the EPOA may face damages and other remedies, including attorneys' fees and costs. Therefore, employers must ensure compliance to avoid potential legal repercussions.
